Collective Bargaining Agreement 2005-2008
ARTICLE 34
DURATION
AND IMPLEMENTATION

Except
as provided in provisions 34.2 and 34.3 below, this Agreement shall become effective upon ratification by both parties
and shall remain in full force and effect up to and including
June 30, 2008. |
|
|
All contractual
provisions changed from the prior Agreement shall be effective
upon ratification of this Agreement by both parties except that wherever a date
is specifically indicated herein as the effective date for a
change, such specifically indicated date shall govern. |

APC has the right to exercise one or two one-year extensions of this Agreement. |

A. |
The CSU shall provide to APC, no later than May 30, 2008, a proposal for the mutual modification of the Agreement by extending it through June 30, 2009 and providing a compensation increase for the period of the extension. The CSU's proposal shall include neither the establishment of any new performance-related salary program nor the dedication of statewide compensation funds for any existing performance-related program. After considering the CSU's proposal and discussing it with the CSU, APC will determine whether it desires to extend the Agreement through June 30, 2009. The Union shall notify the CSU of its decision within thirty (30) days of its receipt of the CSU's proposal. Should APC not exercise its extension option, the HEERA negotiation process for a successor agreement shall commence when one of the parties delivers to the other its proposals, in writing, no later than July 31, 2008. The parties agree that in this event the Agreement will be extended at least through December 31, 2008 while negotiations for a successor agreement take place. |

In the event the Agreement has been extended through June 30, 2010 pursuant to provision 34.3 above, negotiations for a successor agreement shall commence when one of the parties delivers to the other its proposals, in writing, no earlier than February 1 and no later than March 1, 2010. |

Any term(s) of this
Agreement which is deemed to carry an economic cost shall not
be implemented until the amount required therefor is appropriated
and made available to the CSU for expenditure for such purpose(s).
If less than the amount needed to implement this Agreement is
appropriated and made available to the CSU for expenditure,
the term(s) of this Agreement deemed by the CSU to carry economic
cost shall automatically be subject to the meet and confer process. |
