Continue, Terms of Expired Contract Remain in Force

The APC/CSU
contract expired on June 30, 2003. But it’s still in effect. How
can that be? Because California statute provides that as long as
negotiations are continuing for a successor contract, the employer
is obligated to maintain the terms of the expired contract.
The two notable
exceptions to this are legal provisions that aren’t superseded by
our contract:
- Overtime earned starting July 1 must
be compensated monetarily. Federal law precludes the
CSU from giving employees CTO for this time.
- Grievances filed after June 30 are not subject
to binding arbitration.
But CSU unions have virtually always been successful in addressing
this in their new contracts, so that these grievances ultimately
can be taken to arbitration if necessary.
So other than these two exceptions, our contract
is still in effect. And APC isn’t relenting one bit in our efforts
to enforce the terms of that contract on behalf of everyone in Unit 4!
